1. LEGAL INFORMATION. OWNERSHIP OF THE PORTA

   1. Water Loss 2024, with its address at San Sebastián City Hall, C/ Ijentea, 1 - 20003 Donostia-San Sebastián (Guipúzcoa) and with Tax no. P2007400A (hereinafter, “WATER LOSS 2024”), is the owner of the Internet portal accessible through the url www.waterloss2024.org (hereinafter “the Portal”), which it makes available to Internet users for the purpose of providing information to the Portal users (hereinafter “the Users”) on the activity and services of WATER LOSS 2024.

   2. Access to the website is free of charge, except for the cost of connecting to it through the telecommunications network supplied by the access provider contracted by the Users.

2. GENERAL TERMS AND CONDITIONS OF USE AND ACCEPTANCE

   1. These General Terms and Conditions of Use or Use of the Portal (hereinafter, indistinctly, “the Portal”), together with any others specifically established for any service or activity in particular (hereinafter “the Services”), govern all relations established via the Internet between the Portal Users and WATER LOSS 2024, as owner of the Portal.

      These General Terms and Conditions of Use or Use of the Portal will apply both to promotional activity and to providing of the Services; they will govern simple browsing of the Portal by the User, as well as providing of the services offered in the Portal framework, whether or not they are exclusively intended for the partners; however, said services may be subject to additional rules established in specific cases.

   2. Said particular conditions, when established, will replace, complete and/or modify these General Terms and Conditions of Use or Use of the Portal, and their express acceptance may be required before starting to provide the service to which they refer.

   3. Simply by accessing the Portal and/or by using the services included herein makes you a User of the Portal. Both browsing and using the services provided in the Portal means that you, as a User, unreservedly accept each and every one of these General Terms and Conditions of Use and of any others particularly established for the Services in the event that you use them and according to the conditions expressly established for them.

   4. WATER LOSS 2024 is free to change, replace and/or update the General Terms and Conditions of Use, and any other specific conditions or clauses particularly established for the Services, by means of publishing said changes or new conditions in the Portal at least 10 days before they come into force. This will give Users prior knowledge of the changes or new conditions and sufficient time to become familiar with them, thereby ensuring that they suffer no negative effects when they do come into force.

3. INTELLECTUAL AND INDUSTRIAL PROPERTY. PROHIBITION OF HYPERLINKS

   1. All content shown in the Portal, and particularly designs, texts, graphs, images, logos, icons, buttons, software, commercial names, trademarks, domain names, industrial drawings and all other audiovisual or sound content, including their graphic design and source codes and, in general, any other signs susceptible to industrial and commercial use, will be subject to the intellectual and industrial property rights of WATER LOSS 2024 or of the third-party owners of the same who have duly authorised their inclusion in the Portal.

   2. Under no circumstances can it be understood that any kind of entitlement or licences whatsoever are granted to all or part of the said intellectual and industrial property rights or that any right or expectation of right is granted. Particularly, under no circumstances is authorisation given to alter, use, reproduce, distribute, publicly communicate or transform the content appearing in the Portal without prior express and written authorisation from WATER LOSS 2024 or from the corresponding owners of the rights.

   3. No links can be established to the Portal from any other website without prior express and written authorisation from WATER LOSS 2024.

4. RESPONSIBILITY OF WATER LOSS 2024

   1. Access to the Portal does not imply the obligation of WATER LOSS 2024 to verify the truthful, accurate, suitable or exhaustive and updated nature of the information supplied through said Portal. It therefore accepts no liability whatsoever in the event of being permitted by current legislation and provided that no criminal acts are committed by this company. WATER LOSS 2024 therefore accepts no liability for decisions made by the User based on the information supplied through the Portal or for its consequences.

      The User recognises and accepts that use of the Portal and of the Services provided is made at their full risk and responsibility.

   2. WATER LOSS 2024 accepts no liability for damages deriving from, by way of an example but not limited to (i) Interferences, omissions, interruptions, computer viruses, faults and/or connection failures in the operational functioning of this electronic system or in the Users’ computer devices and equipment, for reasons outside the control of WATER LOSS 2024, which prevent or delay providing of the services or browsing of the System; (ii) Delayed or obstructed use due to faults or overloads of the Internet or of other electronic systems; (iii) Factors caused by third persons due to unlawful interference outside the control of the Portal and which are not attributable to WATER LOSS 2024; (iv) The impossibility of being able to provide the Service or permit access for reasons not attributable to WATER LOSS 2024, owing to the User, to third parties, or to potential cases of force majeure.

   3. WATER LOSS 2024 does not control the use made of the Portal by Users. Particularly, under no circumstances does WATER LOSS 2024 guarantee that the Users use the Service according to the law, to these General Terms and Conditions, to ethics, generally accepted good customs and public order, nor that they do so with caution and due diligence.

5. OBLIGATIONS OF THE USER

   1. Generally speaking, the User undertakes to observe these General Terms and Conditions, including any particular terms and conditions applicable to any of the activities linked to the Services, and to heed the special warnings or instructions of use contained therein. They also promise to behave according to the law, good customs and good faith, to proceed with adequate diligence for the nature of the service provided, and to abstain from using the Portal or the Services in any way that may prevent, damage or harm its normal functioning, the property and rights of WATER LOSS 2024, of its suppliers, or of the other Users.

   2. Specifically, without implying any kind of restriction whatsoever in the commitment generally assumed by them under the stipulations of the above section, the User undertakes, when using the Portal and Services: (i) To provide truthful data when subscribing to the portal and to keep said data up to date. (ii) Not to insert, store, change or circulate in or from the Portal, any kind of information or material that can be considered slanderous, insulting, obscene, threating, racist, to incite violence or discrimination for reasons of race, sex, ideology, religion, or which in any way goes against ethics, public order, the fundamental rights, public liberties, honour, privacy or image of third parties and current regulations in general. (iii) Not to insert, store, change or circulate by means of the Portal any computer programme, data, viruses, codes, hardware or telecommunications equipment or any other instrument or electronic or physical device susceptible to cause damage to the Portal, to any of the Services, or to any of the devices, systems or networks of WATER LOSS 2024, of any User, of the suppliers of WATER LOSS 2024 or of any third party in general, or which may in any other way cause any kind of alteration or prevent them from functioning normally. (iv) To carefully safeguard the “Username” and “Password” provided to them by WATER LOSS 2024, such as identifying elements and those enabling their access to certain Services, undertaking not to transfer their use or to permit the access of third parties, assuming liability for any damage caused by their wrongful use when they have failed to act with due caution. Similarly, the User undertakes to inform WATER LOSS 2024 without delay, and in any event always within five days, of their loss or theft, and of any other risk of third-party access to their “Username” and/or “Password”. (v) Not to proceed with advertising, promotional or commercial activities through the Portal, to use the contents and, particularly, the information obtained through the Portal or the Services to send advertising, messages for the purposes of direct sale or for any other commercial purpose, or to collect or store the personal data of third parties. (vi) Not to use false identities, or to steal the identity of other people when using the Portal or the Services, including the use of third-party or any other kinds of passwords. (vii) Not to destroy, alter, use for personal reasons, render useless or damage the data, information, programs or electronic documents of WATER LOSS 2024, its suppliers, or third parties. (viii) Not to insert, store or circulate by means of the Portal or Services any content that infringes the intellectual, industrial or trade secret rights of third parties.

6. CORRESPONDENCE

   For the purposes of these General Terms and Conditions, and for any correspondence required between the User and WATER LOSS 2024, the former should send an email (to dbo@donostia.eus) or a written letter to “WATER LOSS 2024”, San Sebastián City Hall, C/ Ijentea, 1 - 20003 Donostia-San Sebastián (Guipúzcoa).

   WATER LOSS 2024 will send correspondence to the User according to the data they supplied on registering by means of the procedures provided in the Portal and/or in the Services, understanding that said notification will be valid when sent to the email previously provided by the User.

   The User therefore expressly accepts email as a valid procedure for sending all correspondence related to use of the Portal or the Services. However, WATER LOSS 2024 will respect the User’s right to withdraw their consent to send them commercial correspondence.

7. APPLICABLE LEGISLATION

   1. These Terms and Conditions will be governed by Spanish law, which will apply in all matters not anticipated in this contract with respect to its interpretation, validity and execution.

   2. The parties expressly waiver any other legal system to which they may be entitled, insofar as is permitted by current law, and expressly accept the decisions of the Courts and Tribunals of the capital city of Madrid in solving any disagreement potentially arising with respect to the interpretation or execution of these contractual conditions.
